An act to require HOAs to serve notice of lien by certified mail, and eliminate foreclosures by HOAs

Also, there is another bill https://ncleg.gov/Sessions/2023/Bills/House/PDF/H542v1.pdf Do not support this bill – it does NOT provide enough protection and it only requires HOAs to send delinquency notices by FIRST CLASS NOT CERTIFIED mail. This means if an HOA tries to “serve” you notice under HB542, such notice can “get lost” and there’s no way to verify an HOA has actually made a confirmed attempt to serve notice. HB542 also still allows HOAs to foreclose on your property when a lien of $2500 is filed against your house. HB542 is a weak attempt to help homeowners. Democratic Representative Ya Liu, of Wake County is behind HB542 and she does not do enough to help homeowners in this draft legislation.
SB312, filed by Senator Kandie Smith is the legislation that offers superior protection for homeowners. SB312 needs our support to protect homes from foreclosure by HOAs.
Senator Smith is clearly doing a better job to support protection for homeowners and homeowner’s rights. Please support her, and SB312!
HB311
HB311 provides for oversight of HOAs under the state Attorney General’s office. This should provide some much needed oversight to ensure that HOAs are acting with due process and fairness. HB311 also direly needs our support!
